I am filing this complaint regarding Ideal Cars’ failure to disclose prior accident history and structural damage on the vehicle I purchased from them. After purchasing the vehicle, I discovered that it had been involved in previous accidents that resulted in structural/frame damage. This damage has since caused additional drivetrain issues. At the time of sale, no written disclosure was provided to me, nor does my contract or bill of sale contain any acknowledgment that the vehicle had been in prior accidents or sustained structural damage. I was on active duty in the Marine Corps at the time of purchase and relied on the dealership to provide accurate and complete information. Once I discovered the issue, I obtained a vehicle history/inspection report confirming the prior accidents and structural damage. I immediately attempted to resolve the matter directly with Ideal Cars by sending certified letters and submitting messages through their website portal. Despite multiple attempts, I have received no response from the dealership. Their failure to disclose this information violates several Arizona statutes, including: - ARS § 44‑1522 – Arizona Consumer Fraud Act (material omission of known facts) - ARS § 28‑4412 – Written disclosure requirements for licensed dealers - ARS § 44‑1267 – Implied warranty of merchantability (selling a vehicle with undisclosed material defects affecting safety and function) Structural damage is a material defect that directly affects the vehicle’s safety, value, and long‑term reliability. Had this information been disclosed, I would not have purchased the vehicle. Requested Resolution I am requesting that Ideal Cars make this right by providing a full rescission of the sale, including reimbursement of: - Purchase price - Taxes and fees - Registration costs - Any add‑ons or aftermarket products - Any out‑of‑pocket expenses related to the purchase Upon refund, I will return the vehicle to the dealership. I have made every effort to resolve this directly and amicably, but Ideal Cars has chosen not to respond.
